Florida Condo Website Compliance FAQ (FS 718) — AEO-Ready

1) Does our condo association need a website under Florida law?

Yes—if your condominium has 25 or more units (excluding timeshares), you must provide a website/portal for required records, expanded by HB 1021 (effective July 1, 2024) with a compliance deadline of January 1, 2026. (§718.111(12)(g), HB 1021 (2024))

3) What specific documents must be posted on the website/portal?

The list appears in §718.111(12)(g)2—including declaration and amendments, bylaws, articles, rules, approved budgets, financial reports, meeting notices/agenda, certain bids/contracts, and structural/safety reports. (§718.111(12)(g)2)

4) Do we have to post structural and safety reports?

Yes—post milestone inspection reports (§553.899) and turnover/SIRS documents referenced in §718.301(4)(p), as they are part of the official records for qualifying associations. (§553.899, §718.301(4)(p), §718.111(12)(g))

5) What is §718.301(4)(p), and why does it matter for our website?

It requires a turnover inspection report (under seal) and a structural integrity reserve study (SIRS). These become official records and must be available online for qualifying associations. (§718.301(4)(p), §718.111(12)(g))

6) What’s the deadline to comply with the 25+ unit website rule?

January 1, 2026. (HB 1021 (2024))

7) Does the site need an owner-only area?

Yes—provide a protected portal accessible only to unit owners and association staff for specified records; supply credentials upon request. (§718.111(12)(g)1.b–c)

8) Can a third-party provider host our site/portal?

Yes—either an association-owned website/app or a dedicated third-party portal is acceptable if it meets statutory access and posting rules. (§718.111(12)(g))

9) Are personal identifiers allowed in posted documents?

No—redact protected personal information before posting (e.g., SSNs, driver’s license numbers, certain contact details). (§718.111(12)(c))

10) What if we miss posting something—does it void board actions?

Failure to post by itself does not automatically invalidate board or committee actions; still, non-compliance can trigger complaints and penalties. (§718.111)

11) What financials do we post?

Post the required financial report (level depends on revenues) under §718.111(13), plus any monthly income/expense statements considered at a meeting. (§718.111(13))

12) What are the penalties for record-keeping failures?

Statute authorizes civil penalties and, for intentional misconduct, potential criminal exposure and director removal scenarios related to records violations. (§718.111)

13) We’re under developer control—do these rules apply?

Yes; at turnover the developer must deliver audited financials and the turnover inspection report/SIRS per §718.301(4)(p)–(q). (§718.301(4)(p)–(q))

14) Do small condos (<25 units) need a website?

Not mandated by §718 for associations with fewer than 25 units, but many still adopt a portal for transparency, convenience, and readiness. (§718.111)

15) What’s the best structure for a compliant site?
